With your purchase and installation, the buyer confirms that they have read and understood the following warnings. The buyer agrees that he/she is responsible for all damages and injuries caused by the installation and use of the product, which include personal injuries and property damages.
Gun Safety is your Responsibility
By owning/possessing a gun, you take upon yourself complete accountability for the safe storage and security of the weapon. The locking system used by our products is classed as a low security safe. The safe has been designed to be disguised. Part of its security is that it does not look like a safe or locked box. Buyer assumes all responsibility for keeping the safe hidden. The security of the safe requires the buyer not to tell anyone about the safe. Take precaution that no one is around when you open the safe. Installation and operation of the safe should not be done in the presence of children or the mentally ill, or a person that could harm themselves or other with the items hidden in the safe. You agree to Hold Harmless Agreement which is made by and between you (hereinafter, “Customer”) and St Helens Decor LLC and all its members and affiliates (hereafter, “St Helens Decor”). St Helens Decor and customers are sometimes individually referred to as : ”party” and collectively referred to as the “Parties.” WHEREAS Customer desires to hold harmless St Helens Decor from any claims and/or litigation, use, and/or transfer of products sold by St Helens Decor, its members, and all affiliates. NOW THEREFORE, in consideration of the mutual covenants and conditions contained herein, St Helens Decor and customer hereby agree as follows:
Terms
Hold Harmless: Customer shall defend, indemnify, and hold harmless St Helens Decor from any and all actual or alleged claims, demands, causes of actions, liability, loss, damage and/or injury (to property or persons, including without limitation of wrongful death), whether brought by an individual or other entity, or imposed by a court of law or by administrative action of any federal, state, or local governmental body or agency, arising, out of incident to any acts, omissions, negligence or willful misconduct of Customer, its personnel, employees, agents, contractors, or volunteers in connection with or arising out of Customer’s actions. This indemnification applies to and includes, without limitation, the payment of all penalties, fines, judgments, awards, decrees, attorney’s and related costs or expenses, and any reimbursements to St Helens Decor for all legal expenses and costs incurred by it.
Authority to Enter Agreement: Each Party warrants that the individuals who have entered into this agreement have the legal power, right, and authority to make the Agreement and bind each Respective Party.
Amendment; Modification: No supplement, modification, or amendment of this agreement shall be binding unless executed in writing and signed by both parties.
Waiver: No waiver of any default shall constitute a waiver of any other default or breach, whether of the same or other covenant or condition. No waiver, benefit, or privilege, or service voluntarily given or performed by a party shall give the other party any contractual right by custom, estoppels, or otherwise.
Attorney’s Fees and Costs: If any legal action or other proceeding is brought in connection with this Agreement, the successful or prevailing party shall be entitled to recover reasonable attorney’s fees and other related costs, in addition to any other relief to which the Party is entitled.
